Although enjoying the humor often involved, Peak Stupidity has a more nuanced view of the proverbial Florida Man than most, errr, news outlets(?). We don't always sympathize - as with this Florida Man who took a not so nice shot due to his unhappiness with a haircut. OTOH, we are generally predisposed toward rednecks, such as those Florida Men who are competent with front-end loader machines even when drunk off their asses.
We were quite heartened to read the Gateway Pundit story reporting Florida Man Arrested After Shooting Down Walmart Delivery Drone. This was in Lake County Florida last week, as the drone was doing a demonstration.
Lake County is just north of the center of Florida. It's west of Orlando, south of Ocala, north of Lake City, and well northeast of Tampa Bay. It's big cattle country and was a big citrus growing area until the huge Global Warming induced cold wave at the end of 1989 destroyed much of the groves. Now it's getting developed big-time, like lots of Florida has especially as of late. This development is bad enough if you are already a Florida Man, wanting your peace and quiet. The last thing you want in your rural spread is a damn Wal-Mart drone flying over your property.
The "shooting down" part is questionable, as we read in the one short article by GP's Anthony Scott that:
Despite taking a bullet, the drone was able to fly back safely to Walmart, ...Damn! At least though:
... but an investigation revealed the drone received close to $2,500 worth of damages.So there's that, at least. Still, if it got back to Wal-Mart, it unfortunately wasn't exactly "rendered inoperable".
What we are impressed with is that this was a 9 mm pistol round, not pellets from a shotgun. "What a good shot, man!"

I don't really know much about this 1990s band named Filter. Their one hit I remember hearing about 10 years after its time (1999) was, Take a Picture. I think that song is fantastic, with a really great melody and sound, so we featured it early on in the life of this blog.
Their older music, such as this one, from their album Short Bus, is said to be of the "Industrial Rock" genre. Filter played songs for a bunch of movie soundtracks too.

PS: Sorry, Alarmist, I didn't catch what you meant the first time. Thanks for the correction. Yes, that recent SCROTUS decision is important. Everything is "rulemaking" now, "proposals for rulemaking" don't involve the voters. With the huge Fed Bureaucracy, the Congress CAN'T vote on every little thing, but then that was the general idea.

Well, as far as I can tell, David Boggs filed a federal law suit against The Drone Slayer (his words, not mine) that asked the court to require Merideth to pay Boggs, "such equitable relief as it deems appropriate, including monetary damages, prejudgment interest, and the cost of filing this action."
Fortunately, on March 21, 2017, Thomas B. Russell, Senior Judge of the United States District Court, dismissed the lawsuit with prejudice for lack of jurisdiction.

(Easement and Right of Way is something that I most unfortunately know way too much about thanks to the criminal organization and publicly traded company known as AEP.)
You do realize than an easement is a ๐๐๐๐๐๐๐๐ (mutual assent, expressed by a valid offer and acceptance over time with consideration) allowing someone or some entity access to use and or enjoy some part of your existing property rights.
Usually these easements are for things like roads or driveways (ingress and egress over and along such land as defined in the easement contract)(whether public or private), power lines, pipelines, fiber optic lines, telephone lines, co2 lines (see the rice partners case) and to a lesser extent railroads or whatever other property right(s) (in whole or in part) that can be contracted away.
I highly doubt that Walmart has an easement with Mr. Florida man. If they do in fact have an easement (that they purchased from Mr. Florida Man) then Mr. Florida man would have no right to shoot down the drone provided that Walmart abided by the terms of the easement.

(Which now includes drones.)(Though, it would also be appropriate to regulate and even register/license these delivery drones because they are operating in commerce. That drone supposedly was delivering stuff, so might fall under the easement. If it was flying ten feet above the ground though, I'm not sure the easement thing covers it. Among other things, the easement is supposed to infringe *minimally*.

PS: I meant to clarify earlier that the rules on aircraft minimum altitudes were for safety, but not necessarily anything involving property rights. 1,000 ft above ground level in "congested areas", 500 ft agl in non-congested, but I suppose not "sparsely populated", and, lastly that 500 from any man-made object in sparsely populated areas.

PS: Thanks for that story about the Kentucky Man v the drone, Mr. Smith. That was from '15. IMO and based on some law quoted by commenter MBlanc46, "things always get worse". It seems that people such as Bullitt County Judge Rebecca Ward are few an far between. She being a woman judge even, had me think that the following probably hit home and clinched* the case:
"He told NBC News at the time that the device was flying near his yard and he "had no way of knowing (if) it was a predator looking at my children.":
That may or may not have really been the case, but that's what a good lawyer would tell you to say.
As Mr. Hail was commenting under another recent post, we will have fewer and fewer people like this Judge Ward, people who often resist Statism. We are importing multitudes of people who have no such thoughts. They are perfectly happy being enforcers for The State.

Mr. Blanc, as The Alarmist explained under common law landowners enjoyed quite a bit of airspace. Before the advent of aviation the airspace over one's property was considered part of your private property and it went all the way upto the heavens. (Your private airspace was unlimited.)

That they are trying to do away with personal airspace entirely is not surprising as these filthy communists are trying to get rid of all forms of property, private or otherwise. Mr. Blanc, as The Alarmist explained under common law landowners enjoyed quite a bit of airspace. Before the advent of aviation the airspace over one's property was considered part of your private property and it went all the way upto the heavens. (Your private airspace was unlimited.)

The FAA has all sorts of rules, but they cover "navigable airspace". The term "controlled airspace" means something different than most people think. One can fly under controlled airspace at 1,200' above the ground in most place and 700' above it in others. There's a rule about being over 500 ft agl, but in "sparsely populated" areas one much just be 500 ft AWAY from any obstacle. Over a lake, for example, a ship's mast might stick up 50', so theoretically, one must be 500' OVER that or off to the side. Nobody, but nobody, does the math or cares very much.
Drones that fly under 400 agl (not counting in areas very close - defined clearly in the FAA regs - to towered airports or on approaches to all runways) are not under these navigable airspace rules. Criminal-law-wise, they can fly anywhere else.
What Alarmist said about property is what I've also read. The civil law on property rights hasn't kept up with drones. What if a drone flies 10 ft above your lawn? I think some of this stuff has got to be nailed down. In the meantime, I hope to see more of the actions of Florida man here, to push the law and to push back against Orwellian behavior. What Alarmist said about property is what I've also read. The civil law on property rights hasn't kept up with drones. What if a drone flies 10 ft above your lawn? I think some of this stuff has got to be nailed down. In the meantime, I hope to see more of the actions of Florida man here, to push the law and to push back against Orwellian behavior. (Anyway, what privacy do we REALLY have when we have IEspionage recording devices in our pockets?)

PS: Alarmist, the base to short final turn at one airport I've been to a bunch put one was over a golf course. Running the throttle back and forth didn't really worry anyone. So, I'd start screwing with the prop controls. The engine RPMs going up and down like that got some attention, haha. Fore!!
M, that's something the GP commenters had big discussions about. True, you'd better watch the background. I assumed he was in a fairly rural area. What comes up, must come down, but not nearly as fast* (doesn't mean it can't kill someone).

With the advent of UAVs for commercial purposes, the FAA has taken the regulatory position that โnavigable airspaceโ is pretty much anything outdoors, e.g. they assert there is no such thing as private airspace outside of oneโs home. This is at odds with earlier common law that defined private airspace as that which a landowner could use or occupy; it was certainly some point well above the gound.
Anyway, weโll see if this now rises through the courts to apply the recent ruling on the so-called โChevron Deferenceโ to test the FAAโs regulatory overreach.

I used to use a practice area east of Orlando to do training flights, and it is over a mix of marsh and cattle ranches. So when you pull the power to simulate an engine out and set into a spiral to lose altitude over the spot you designated as possibly safe for a forced landing, your idling engine backfires as the wind flows over the propeller, and as you look out the window you occasionally see frightened cattle fanning out from your target. Good thing I never encountered Florida Man during those sessions, but there were no houses in those parts in those days.
